States That Fireworks Are Legal

YOUNGSTOWN, Ohio (WJW) — Weeks before the Fourth of July holiday, Phantom Fireworks is recommending people buy their fireworks early because of a possible shortage — at least in states where it`s legal. The country`s leading fireworks retailer says supply chains are slow due to global deliveries. In Australia, most states and territories prohibit fireworks for consumers. [14] [15] Tasmania, ACT and Northern Territory allow use with permission (subject to calendar date and circumstances). [16] However, on 1 July, the territory`s day, fireworks may be used freely in the Northern Territory without permission. [17] In the southern states, everything revolves around fireworks, although there are some exceptions. Alabama, Arkansas, Georgia, Kentucky, Louisiana, Mississippi, Oklahoma, South Carolina, Tennessee and Texas allow the use of fireworks. Florida, North Carolina, Virginia and West Virginia do not allow explosive fireworks in the hands of unauthorized citizens. In Maine, fireworks can only be sold to people over the age of 21 at fireworks stores, with the exception of fireworks, which can be sold at stores that sell items other than propane or other explosives. The following states allow the most fireworks: Alabama, Alaska, Arkansas, Georgia, Iowa, Indiana, Kansas, Kentucky, Louisiana, Maine, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Mexico, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Washington, West Virginia and Wyoming. In Ireland, imports of consumer fireworks are strictly controlled and their use must be monitored by a professional fireworks operator. [5] This has led to significant smuggling of fireworks out of Northern Ireland, where the rules governing the sale of fireworks are more permissive.

[6] «Like many other industries, the fireworks industry has experienced delays due to shipping challenges facing the global market,» said Alan L. Zoldan, Executive Vice President of Phantom. «The good news is that we prepared early for the strong demand this year and encourage Phantom customers to do the same,» Zoldan said. «We`re always thrilled to be a big part of America`s favorite holiday, the fourth of July, which is especially important after the summer 2020 pandemic.» In Iceland, fireworks will be sold from December 28 to 31 and again on January 6. Here are all the states where fireworks are legal – and if you live in one of the states that ban all fireworks, you have my sympathy: In Sweden, fireworks are not allowed to be sold to people under the age of 18. Categories 1 (indoor), 2 (garden) and 3 (exhibition) are open to the public – category 4 (professional) is reserved for licence holders. Fireworks are available all year round, but are mostly sold before New Year`s Eve. In urban areas, they can only be fired on New Year`s Eve, Easter Vigil and Walpurgis night without police permission. There may also be time arrangements on these days, but this depends on the municipality in which the user is located. Three states — Illinois, Ohio and Vermont — only allow the use of wire or wooden sparklers and other novelties, with Illinois and Vermont limiting sales to the same items. Three states — Hawaii, Nevada and Wyoming — allow each county to set its own regulations.

Laws regarding fireworks in use vary from country to country and state to state. In Argentina, fireworks were banned in 2019 by a national decree based on Article 14 of the National Constitution and requests from animal welfare organizations and autistic parents at public performances. Otherwise, most fireworks are completely legal all year round. [19] Many Native American tribes have fireworks shops on reserve lands that are released from state and local authorities and sold to people who are not part of the tribe. In the Netherlands, fireworks (with the exception of category 1) cannot be sold to persons under the age of 16. They will only be sold for the last three days until December 31st included. If one of these days is a Sunday, the sales period is until the 30th inclusive. December moved to the 28th. Fireworks can only be fired between 6 p.m.

on New Year`s Eve and 2 a.m. the next day. Category 1 fireworks can be used year-round. Most northeastern states ban consumer fireworks (sorry, New Englanders!). Consumer fireworks that explode in the sky are only legal in Maine and New Hampshire. They are illegal in Connecticut, Delaware, Maryland, Massachusetts, New Jersey, New York, Pennsylvania, Rhode Island and Vermont. Since each state has very specific rules for each type of fireworks, check the Consumer Product Safety Commission`s list for your state`s laws. Today, fireworks are legal to buy in 46 states and Washington, DC. Ohio, Vermont, and Illinois only allow the purchase of candles and other new fireworks, and Massachusetts does not allow the sale of fireworks at all. Critics of these fireworks bans investigate how easily people can cross state borders to buy fireworks, especially in the small state of Massachusetts. They also examine how much safety regulations for fireworks have increased in recent decades, so promoting good fireworks education may be more effective in preventing injuries than banning them altogether.

However, buying less powerful fireworks, which do not require a license from the Bureau of Alcohol, Tobacco, Firearms and Explosives, is not always so easy for a consumer. That`s largely because fireworks aren`t always readily available, as state laws for fireworks vary across the country, prompting consumers to often cross state or county borders to purchase certain types of fireworks banned in their home jurisdiction. Fireworks that can be purchased in most states include Roman candles, candles, poppers, snakes, helicopters, land moths, and fireworks with multiple pipes. You must have less than 50 mg of gunpowder and follow other regulations. In addition, consumer fireworks fuses must burn for at least three seconds, but no more than nine seconds, to ensure that they do not explode in the face of the person lighting them. Massachusetts is the only state that completely bans all fireworks, although they allow professionals to host fireworks.
